New Schedule 1 Employment Tribunal Procedure Rule 2024

New Schedule 1 Employment Tribunal Procedure Rule 2024 has come into force effective as of 6 January 2025 as noted by Daniel Barnett, Barrister.

What does this mean?

The information is important to keep up to date with Employment Tribunal representation regarding Claimants making a claim, or Respondents defending a claim when acting as a Litigant In Person, or for those representing in the legal field such as an Employment Law solicitor/ lawyer, or barrister.

In essence, the Employment Tribunal Procedure Rules 2024  are largely the same as rules of procedure set out in Schedule 1, Employment Tribunal (Constitution and Rules of Procedure) 2013 with some changes in numbering and amendments regarding Tribunal Governance changes, including but not limited to:-

Governance

  • rule 7: inclusion of a power for the Employment Tribunal to delegate functions of a judicial nature to legal officers
  • rules 59 and 60: a presiding member can approve and sign judgments and written reasons whereas previous only an Employment Tribunal judge undertook this.

Numbering changes

  • rule 8 (presenting a claim) becomes rule 10
  • rule 16 (response) becomes rule 17
  • rule 30 (applications for case management orders) becomes rule 31
  • rule 37 (striking out) becomes rule 38

This is being circulated with REJ Franey’s agreement and with the agreement of the President of Employment Tribunals (England & Wales).
